I. INTRODUCTORY PROVISIONS

Article 1: Scope and validity

These general terms and conditions (hereinafter: “general terms”) govern the rights and obligations between the provider and customers when purchasing products via the online store aladdin.si. The general terms form an integral part of every distance sales contract concluded between the provider and the customer.

The general terms are drawn up in accordance with the applicable legislation of the Republic of Slovenia and the European Union, in particular the following regulations:

  • Obligations Code (Obligacijski zakonik, OZ),
  • Consumer Protection Act (Zakon o varstvu potrošnikov, ZVPot-1),
  • Electronic Commerce Market Act (Zakon o elektronskem poslovanju na trgu, ZEPT),
  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation or GDPR),
  • Personal Data Protection Act (Zakon o varstvu osebnih podatkov, ZVOP-2),
  • Out-of-Court Consumer Dispute Resolution Act (Zakon o izvensodnem reševanju potrošniških sporov, ZIsRPS).

By placing an order, the customer confirms that they are fully acquainted with these general terms, that they understand them and agree to them unconditionally. The general terms are available to the customer at all times on the website aladdin.si.

Article 2: Provider details

The provider of e-commerce services and owner of the online store aladdin.si (hereinafter: “provider” or “seller”) is:

  • Company: Aleš Žlavs s.p., storitve in trgovina
  • Registered office: Dol pod Gojko 21B, 3213 Frankolovo, Slovenia
  • Registration number: 3969584000
  • VAT ID: SI16980204
  • VAT registered: YES
  • Date of entry in the Slovenian Business Register (AJPES): 09. 05. 2011
  • Bank account: SI56 0223 2142 5442 306 (NLB d.d.)
  • E-mail address for communication: [email protected]
  • Telephone number for communication: +386 68 162 600

This information is made easily, directly and permanently accessible to customers and the competent authorities in accordance with the requirements of the Electronic Commerce Market Act. Providing complete and accurate identification data is the foundation of transparent business and gives customers clear knowledge of the contracting party with whom they are entering into a legal transaction. This is essential for exercising the rights and obligations arising from the concluded contract and is a basic precondition for trust in electronic commerce.

Article 3: Definitions

  • Online store: The website on the domain aladdin.si that enables the purchase of products at a distance.
  • Provider (or Seller): Aleš Žlavs s.p., as defined in Article 2 of these general terms.
  • User: Any person who visits the online store. Upon registration, the user becomes a registered user.
  • Customer: Any natural or legal person who makes a purchase in the online store.
  • Consumer: A natural person who acquires or uses goods and services for purposes outside their professional or gainful activity, as defined by ZVPot-1. The provisions of these general terms that expressly refer to consumers apply exclusively to them.
  • Distance contract (or Sales contract): A contract concluded between the provider and the customer under an organised distance sales scheme, without the simultaneous physical presence of the contracting parties, with the exclusive use of one or more means of distance communication (e.g. online store, e-mail) up to and including the moment the contract is concluded.
  • Item (or Product): Any piece of goods that is the subject of sale in the online store.

II. PURCHASING PROCEDURE AND CONCLUSION OF THE CONTRACT

Article 4: Range of items, prices and promotional codes

Due to the nature of the business, the range of items in the online store is regularly updated and changed. Each item is presented with basic information, a description of its characteristics and a photograph. All photographs are symbolic and do not necessarily guarantee all the characteristics of the product; they serve as an informative illustration.

Descriptions of decanted perfumes focus on the characteristics of the fragrances, their notes and composition, in order to give the customer the best possible idea of the scent. Direct comparisons with other brands that could be misleading or constitute an infringement of intellectual property rights are avoided. This practice is key to reducing legal risks, since claims of identity with originals could constitute an unfair commercial practice under ZVPot-1 and at the same time open the possibility of lawsuits by trademark holders. By emphasising our own independent fragrance descriptions, compliance with regulations is ensured and trust is built on the quality of our own product.

The range includes in particular: inspired perfumes of the own brand Aladdin Perfumery House, perfumes of original brands, cosmetics and care products, jewellery, laundry and home fragrances, 100 % natural essential oils, soy candles with essential oils, and aroma diffusers and nebulisers. Inspired perfumes are independent products of the provider and are neither original products nor copies of the brands that inspire them.

Prices

All prices listed in the online store are expressed in euros (EUR) and already include value added tax (VAT), unless expressly stated otherwise. Prices do not include delivery costs; these are calculated and displayed separately during the checkout process.

Prices are valid at the time the order is placed and have no predetermined period of validity. The provider reserves the right to change prices without prior notice. For an individual purchase, the price published at the time the order is confirmed applies.

In the event of an obvious error in the published price (e.g. a price of 0.00 EUR or a price disproportionately low in relation to the characteristics of the product), the provider reserves the right to withdraw from the contract, even if the customer has already received an automatic confirmation of receipt of the order. In such a case, the provider will immediately notify the customer of the error and offer them the option of purchasing at the correct price or withdrawing from the contract. Such a procedure is in line with the principle of good faith and fair dealing and good business practice.

Promotional codes (discount coupons)

Promotional codes provide various benefits when purchasing. Each code is limited in time and its conditions of use are clearly defined in the promotion itself. As a rule, codes cannot be combined and only one promotional code can be redeemed per purchase.

Article 4.a: Special conditions for ordering testers

(1) The provider enables customers to order fragrance testers in small quantities, the sole purpose of which is to allow the fragrance to be tried before purchasing a larger size.

(2) Testers are available at a symbolic price that covers the costs of preparation, packaging and packing. This amount, which may be referred to as a “handling fee” or “processing fee”, is clearly and unambiguously stated next to each individual tester before the order is placed. A tester is not considered a free product but the subject of a sales contract at the published price.

(3) Given the nature and purpose of testers, which are intended exclusively for personal use and trial, and for reasons of health protection and hygiene, testers are exempt from the right of withdrawal in accordance with the Consumer Protection Act (ZVPot-1). Ordered and received testers cannot be returned or exchanged under any circumstances. By placing an order for a tester, the customer expressly confirms that they are aware of these conditions and agree to them.

Article 4.b: Special provisions for essential oils, candles, diffusers and nebulisers

(1) Essential oils are 100 % natural and intended exclusively for scenting rooms in aroma diffusers and nebulisers. They are not intended for ingestion, undiluted application to the skin or medical treatment; the descriptions on the website are for information purposes only and do not constitute health claims. The products are labelled in accordance with Regulation (EC) No 1272/2008 (CLP). Before use, the customer must read and observe the warnings and instructions on the label, keep the oils tightly closed, protected from light and heat, and out of reach of children and pets. Pregnant or breastfeeding women and persons with epilepsy, asthma or allergies should consult a doctor before use.

(2) Candles must be used exclusively on a level, non-flammable and heat-resistant surface, never unattended, near flammable objects, in a draught or within reach of children and pets. Before each lighting, trim the wick to approximately 5 mm; a candle should burn for no more than 4 hours at a time, and the last centimetre of wax should not be lit.

(3) Diffusers and nebulisers are electrical devices. They must be used in accordance with the enclosed manufacturer’s instructions; nebulisers exclusively with pure essential oils, ultrasonic diffusers with water and a few drops of oil. Devices must not be exposed to moisture, heat or direct sunlight, and batteries must not be opened. End-of-life devices do not belong in household waste but must be handed in at a collection point for waste electrical and electronic equipment.

(4) The provider is not liable for damage resulting from the use of products contrary to their intended purpose, the instructions or the warnings set out in this Article and on the label (see also Article 18).

Article 5: Ordering procedure and technical steps for concluding the contract

Purchases in the online store are made in accordance with the provisions of the Electronic Commerce Market Act, which ensure the transparency and security of the procedure. The technical steps leading to the conclusion of the sales contract are as follows:

  1. Selecting products: The customer selects the desired products on the website and adds them to their virtual shopping cart by clicking the “Add to cart” button. The customer can review the contents of the cart, change product quantities or remove products from it at any time.
  2. Reviewing the cart: After selecting the products, the customer proceeds to the shopping cart page. Here they can once again review the entire contents of their order, including products, quantities and subtotals. At this step they can also enter a promotional code, if any.
  3. Entering details: The customer proceeds to the checkout (“Checkout”), where they enter all the details required to process the order: first and last name, delivery address, e-mail address and telephone number. They also select the delivery method and payment method.
  4. Review and correction of errors: Before finally placing the order, the customer is shown a page with a complete summary of the order. This page serves as a technical means of identifying and correcting errors. The customer can check all the entered details (personal data, delivery address, order contents, final amount including delivery costs) and correct them if necessary by clicking the edit button for the relevant section. This step is mandatory under ZEPT and ensures that the customer places a correct and intended order.
  5. Placing the order with an obligation to pay: By clicking the button clearly and unambiguously labelled with text such as “Complete purchase” or “Place order and pay”, the customer places a binding order. By doing so, they confirm that they agree to the payment and to the general terms and conditions.

Article 6: Order confirmation and conclusion of the contract

The procedure for concluding the contract is designed in accordance with the provisions of the Obligations Code on offer and acceptance:

  1. The placed order as an offer: When the customer successfully places an order in accordance with the procedure in Article 5, their order is deemed to be an offer to conclude a sales contract under the conditions stated in the order and in these general terms.
  2. Automatic confirmation of receipt of the order: After placing the order, the customer receives an automatically generated message entitled “Order receipt confirmation” at their e-mail address. This message merely confirms that the provider has received the customer’s order in its information system. This message does not constitute acceptance of the offer and does not oblige the provider to deliver the ordered products. It serves solely to notify the customer that the ordering process was technically successful.
  3. Acceptance of the offer and conclusion of the contract: The sales contract between the provider and the customer is concluded at the moment the provider reviews the order, checks the availability of the ordered items and sends the customer a second e-mail entitled “Order confirmed”. With this message, the provider accepts the customer’s offer. From this moment on, all prices and other conditions are fixed and binding on both the provider and the customer. If the ordered product is out of stock or the order cannot be fulfilled for another justified reason, the provider notifies the customer and rejects the order. In this case, no contract is concluded.

This two-stage procedure enables the provider to manage stock efficiently and prevents the conclusion of contracts for products that are not available, thereby avoiding potential disputes and ensuring a higher level of service.

Article 7: Payment methods and invoicing

The provider offers the following payment methods:

  • Cash on delivery: The customer pays the purchase price to the courier upon receipt of the parcel. This payment method incurs an additional cash-on-delivery fee of 1.50 EUR, which is displayed before the order is placed.
  • Payment by pro forma invoice (bank transfer or FLIK instant payment): After placing the order, the customer receives a pro forma invoice with all payment details at their e-mail address. The order is processed after the payment is received in the provider’s bank account.
  • Payment by card (Revolut): The online store enables secure payment with Visa, Mastercard, Maestro and American Express cards via the certified Revolut payment system. Revolut Pay and Google Pay are also available via the same system. Card details are entered directly with the payment service provider and are not stored by the provider.
  • Payment via PayPal: The customer is redirected to the secure PayPal page, where they make the payment with their PayPal account, a payment card, Google Pay or Apple Pay.

For every completed order, the provider issues an invoice with itemised costs and sends it to the customer in electronic form (PDF format) to their e-mail address. By accepting these terms, the customer agrees to receive invoices in electronic form.

Article 8: Storage of the contract

The provider informs the customer that the concluded sales contract (in the form of the confirmed order) will be stored in electronic form on the provider’s server. The contract is stored in a manner that ensures its integrity and accessibility. The customer may at any time request access to their contract (order) by sending a request to the e-mail address [email protected]. The provider will send them a copy of the contract in electronic form. This provision complies with the requirements of ZEPT regarding informing the customer about the storage and accessibility of the concluded contract.

III. CONSUMER RIGHTS UNDER ZVPot-1

Article 9: Right of withdrawal within 14 days

In the case of distance contracts, the consumer has the right to notify the provider within 14 days of taking delivery of the goods that they are withdrawing from the contract, without having to give a reason for their decision. This right is a fundamental consumer right that allows them to inspect and test a product they could not physically examine before purchase.

The 14-day withdrawal period begins on the day on which:

  • the consumer, or a third party other than the carrier and indicated by the consumer, acquires physical possession of the goods;
  • in the case of a contract relating to multiple goods ordered by the consumer in one order and delivered separately: the consumer acquires physical possession of the last item;
  • in the case of a contract relating to the delivery of goods consisting of multiple lots or pieces: the consumer acquires physical possession of the last lot or piece.

Article 10: Procedure and effects of withdrawal from the contract

Obligations of the consumer:

The consumer must unambiguously inform the provider of their decision to withdraw from the contract. This can be done by means of a written statement sent by e-mail to [email protected] or by using the withdrawal form available on the provider’s website. To meet the withdrawal deadline, it is sufficient that the notice of exercising the right of withdrawal is sent before the 14-day withdrawal period expires.

After sending the notice of withdrawal, the consumer must return the goods to the provider without undue delay and in any event no later than within 14 days. The goods are to be returned to: Aleš Žlavs s.p., Dol pod Gojko 21B, 3213 Frankolovo. The consumer is deemed to have returned the goods on time if they send them before the 14-day return period expires. The direct costs of returning the goods are borne by the consumer.

The consumer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Obligations of the provider:

After receiving the notice of withdrawal, the provider must, without undue delay and no later than within 14 days from the day of receipt of the notice, refund all payments received, including delivery costs (except for additional costs resulting from the choice of a type of delivery other than the least expensive type of standard delivery offered).

The provider refunds the payments received using the same means of payment as used by the consumer, unless the consumer has expressly requested the use of another means of payment and incurs no costs as a result.

The provider may withhold the refund until it has received the returned goods or until the consumer has supplied evidence of having sent the goods back, unless the provider has offered to collect the returned goods itself.

Article 11: Exceptions to the right of withdrawal

In accordance with the provisions of the Consumer Protection Act (ZVPot-1), the consumer does not have the right of withdrawal in the case of certain specific types of contracts. The following exceptions and particularities are especially relevant to the range of the aladdin.si online store:

  1. Contracts for the supply of goods made to the consumer’s precise specifications and adapted to their personal needs.
    • This exception applies to goods that are not prefabricated but are made by the provider on the basis of the consumer’s personal choice or decision. Quantities are prepared on demand according to the quantities ordered, which is why such orders are considered personalised.
  2. Contracts for the supply of sealed goods which are not suitable for return for health protection or hygiene reasons and which have been unsealed by the consumer after delivery.
    • This exception is key for products such as perfumes and other cosmetics. As these are products for personal use, an opened product would pose a health and hygiene risk and therefore cannot be resold.
    • The consumer loses the right of withdrawal at the moment they open or damage the primary packaging of the product.
    • The same applies to jewellery with fragrance beads if the beads or fragrance are packaged in sealed packaging for hygiene reasons.
  3. Essential oils, candles, diffusers and nebulisers.
    • Essential oils are sealed goods which, for health protection and hygiene reasons, are not suitable for return once the protective closure (seal) has been opened or damaged. Unopened oils with an intact seal may be returned within 14 days in accordance with Articles 9 and 10.
    • Candles, diffusers and nebulisers may be returned within 14 days if they are unused, in their original packaging and show no signs of use (lit wick, soot, residues of oil or water in the device). If the goods have been used beyond what is necessary to establish their nature, characteristics and functioning, the consumer is liable for the diminished value of the goods and the provider may reduce the refund proportionately.

IV. CONFORMITY OF GOODS AND GUARANTEE

Article 12: Liability for conformity of goods

The Consumer Protection Act (ZVPot-1) introduced the concept of “lack of conformity of goods”, which replaces the previous term “material defect”. The provider is liable for any lack of conformity of the goods that exists at the time of delivery and becomes apparent within two years of delivery of the goods.

Goods are in conformity with the sales contract in particular where (cumulatively) they:

  • correspond to the description, type, quantity and quality and possess the functionality, compatibility and other features as required by the sales contract;
  • are fit for any particular purpose for which the consumer requires them and which the consumer made known to the seller at the latest at the time of conclusion of the sales contract, and which the seller has accepted;
  • are delivered along with all accessories and instructions, including on installation, as stipulated by the sales contract;
  • are fit for the purposes for which goods of the same type would normally be used.

A key novelty of ZVPot-1 is the extension of the period of the reversed burden of proof. If a lack of conformity becomes apparent within one year of delivery, it is presumed to have existed at the time of delivery, unless the seller proves otherwise or unless this presumption is incompatible with the nature of the goods or the nature of the lack of conformity. This means that in the first year after purchase the burden of proof lies with the provider.

Article 13: Procedure for asserting a lack of conformity and hierarchy of remedies

In the event of a lack of conformity of the goods, the consumer has the right to require the provider to bring the goods into conformity. ZVPot-1 introduces a hierarchy of remedies:

1. Primary level (bringing the goods into conformity):

The consumer may first choose between two remedies:

  • free repair of the goods or
  • free replacement of the goods with new, conforming goods.

The provider must carry out the repair or replacement within a reasonable period not exceeding 30 days, without significant inconvenience to the consumer. The choice between repair and replacement lies with the consumer, unless the chosen remedy is impossible or would impose disproportionate costs on the provider compared with the other remedy.

2. Secondary level (price reduction or withdrawal from the contract):

The consumer may demand a proportionate reduction of the purchase price or withdraw from the sales contract and demand a refund of the amount paid only in the following cases:

  • if the provider has not carried out the repair or replacement of the goods or has refused to do so;
  • if the lack of conformity reappears despite an attempt to bring the goods into conformity;
  • if the lack of conformity is so serious that it justifies an immediate price reduction or withdrawal from the contract;
  • if the provider has declared (or it is clear from the circumstances) that it will not bring the goods into conformity within a reasonable period.

Special right of rejection:

If a lack of conformity of the goods becomes apparent within 30 days of delivery, the consumer has the right to reject the goods and may immediately withdraw from the sales contract and demand a refund of the purchase price, without first having to demand repair or replacement.

This hierarchical arrangement requires the adaptation of internal procedures for handling complaints. The provider must guide the consumer appropriately through the procedure, first towards repair or replacement, thereby ensuring compliance with the law and preventing unnecessary disputes.

Article 14: Guarantee

A distinction must be made between the mandatory liability for conformity (defined in Articles 12 and 13), which derives directly from the law and binds the seller, and a voluntary (commercial) guarantee, which may be issued by the manufacturer, importer or seller (guarantor).

  • Voluntary guarantee: The provider does not currently issue its own voluntary guarantee for any goods. If a manufacturer’s or importer’s guarantee certificate is enclosed with the product, the conditions of that guarantor apply. Aroma diffusers and nebulisers, like all other products, are covered by the statutory liability for conformity under Articles 12 and 13 (two years from delivery).
  • Asserting the guarantee: In accordance with the amendments introduced by ZVPot-1, rights under a guarantee are asserted directly with the guarantor named on the guarantee certificate or with its authorised service centre.
  • Relationship to the liability for conformity: A guarantee is a voluntary commitment by the guarantor and in no way excludes or limits the rights the consumer has under the mandatory liability for conformity of goods. The consumer may always assert their rights arising from a lack of conformity against the seller, regardless of the existence of a guarantee.

V. DELIVERY AND COLLECTION

Article 15: Delivery times, costs and methods

Delivery times:

The provider undertakes to dispatch products that are in stock within 1–3 working days of order confirmation (or of receipt of payment in the case of payment by pro forma invoice). If a product is out of stock or the delivery time is extended, the provider will inform the customer by e-mail or telephone.

Delivery methods and costs:

Delivery on behalf of the provider is carried out by the contractual partners GLS and Pošta Slovenije (Slovenian Post). The customer selects the delivery method during checkout, where the delivery cost is displayed before the order is placed. Delivery costs within Slovenia are:

  • GLS Paketomat (parcel locker): 4.00 EUR
  • GLS Paketna trgovina (parcel shop): 4.50 EUR
  • Home delivery (GLS): 4.50 EUR
  • Pošta Slovenije: 5.50 EUR
  • For purchases over 60.00 EUR, standard delivery within Slovenia is free of charge.
  • For orders where the destination country is not Slovenia, the shipping cost is calculated automatically according to the destination and the weight of the parcel. The price is displayed before the order is placed.

If cash on delivery is selected, the cash-on-delivery fee referred to in Article 7 is charged additionally.

Free personal collection of the goods is also possible at the collection point in Celje or at the company’s registered office in Frankolovo, by prior arrangement.

Fragile goods (bottles, candles in glass, diffusers and nebulisers) are protected with appropriate packaging. We ask the customer to inspect the parcel upon receipt and to report any damage to the packaging or contents as soon as possible, preferably within two working days, to [email protected] with photographs, which facilitates the claim with the delivery service. This request does not limit the consumer’s rights under Articles 12 and 13.

Article 16: Handling of uncollected parcels

If the customer does not collect a parcel sent with cash on delivery within the collection period at the delivery service, the parcel is returned to the provider. Failure to collect the parcel is not considered a valid withdrawal from the contract under ZVPot-1, but a unilateral termination of the contract by the customer, by which the customer breaches their contractual obligation to take delivery of the goods.

In such a case, the customer is liable under the Obligations Code for the damage incurred by the provider. The provider reserves the right to claim from the customer reimbursement of the actual and demonstrable costs incurred as a result of the customer’s non-performance of the contract. These costs comprise the cost of sending the parcel and the cost of returning the parcel to the provider. The provider will issue the customer with a payment request for these costs.

The legal basis for such a claim is not to penalise the customer but to compensate the actual damage suffered by the provider as a result of the customer’s breach of contract.

VI. PERSONAL DATA PROTECTION

Article 17: Privacy policy

The provider is committed to protecting the personal data of its customers in accordance with the General Data Protection Regulation (GDPR) and the Personal Data Protection Act (ZVOP-2). This Article provides key information on the processing of personal data; more detailed information is available in the separate document “Privacy Policy” published on the website.

VII. LIABILITY AND COMMUNICATION

Article 18: Disclaimer of liability

The provider makes every effort to ensure that the information published in the online store is up to date, accurate and correct. Nevertheless, the characteristics of items, delivery times or prices may change so quickly that the provider is unable to correct the information in time. In such a case, the provider will inform the customer of the changes and allow them to withdraw from the contract or exchange the ordered item.

The provider is not responsible for the content of product reviews written by users. Before publication, it reviews the opinions and rejects those that contain obvious untruths or are misleading or offensive.

The provider is liable for damage incurred by the customer as a result of a breach of contract in accordance with the general provisions of the Obligations Code. The provider’s liability is excluded for damage resulting from improper or negligent use of the products by the customer.

Article 19: Communication and marketing messages

The provider will contact the customer via means of distance communication (e-mail, telephone) for the purpose of fulfilling the order.

The provider will send marketing messages (newsletters) only to users who have expressly subscribed to receive them (given consent). In accordance with ZEPT, every such message will be clearly and unambiguously marked as an advertising message, the sender will be clearly identifiable, and the conditions for participating in any promotions will be clearly defined. Every message will contain a simple and free option to unsubscribe from receiving further messages, which the provider will consistently respect.

VIII. DISPUTE RESOLUTION

Article 20: Handling of complaints

The provider respects the applicable consumer protection legislation and strives to establish an effective system for handling complaints. In the event of problems or complaints, the customer may contact the provider via the e-mail address [email protected] or in writing at the address of the company’s registered office.

The complaints procedure is confidential. The provider will confirm receipt of the complaint within five working days and inform the customer of the expected processing time. It will keep the customer informed of the progress of the procedure. The provider will endeavour to resolve all disputes amicably.

Article 21: Out-of-court resolution of consumer disputes

The provider is aware of the importance of out-of-court resolution of consumer disputes, but does not currently participate in any of the procedures conducted by registered ADR providers.

In accordance with the provision of the third paragraph of Article 32 of the Out-of-Court Consumer Dispute Resolution Act (ZIsRPS), the provider hereby informs that it does not recognise any provider of out-of-court consumer dispute resolution (IRPS) as competent to resolve a consumer dispute that a consumer could initiate under ZIsRPS.

Article 22: Competent court and applicable law

All disputes arising from the use of the online store and from sales contracts concluded through it that cannot be resolved amicably are governed exclusively by the law of the Republic of Slovenia.

The court with subject-matter jurisdiction in Celje, according to the provider’s registered office, is competent to resolve disputes.

IX. FINAL PROVISIONS

Article 23: Amendments and supplements to the general terms

The provider reserves the right to amend and supplement these general terms. Every amendment will be published on the website aladdin.si and will take effect on the day of publication. Orders placed before the date of the amendment are subject to the general terms in force at the time the order was placed.

Article 24: Validity
